Market Structure Essay Example | Topics and Well Written Essays - 2000 words

Market Structure - Essay Example Conversation of the market structures Perfect market rivalry In flawless market rivalry, business analysts present that there are numerous organizations, value takers, and the quantity of providers will in general be equivalent to the quantity of providers in the market. The explanation of its event is the philosophy that enlightening purchasers and venders manage homogeneous items (Stackelberg, et al 2011). Imposing business model market structure The structure prompts the mastery of the market by one maker of a specific item whose utility serves the requirements of a general gathering of customers along these lines; the business element controls the flexibly and valuing utilities and purchasers rest to no commitment other than making buys at various costs per unit of utilization (Oner, 2013). Monopolistic rivalry The circumstance happens when there are numerous organizations in advertise contending to showcase their items yet regularly contrast as they produce various sorts of item s. The opportunity of section and leave settles upon the purchasers and venders and they clearly need data in this manner they live in an incompletely serious market (Heywood, 2006). Duopoly showcase structure The appearance of duopoly in a market happens within the sight of two firms that are reliant and clearly plot in their offer to execute their projects. There is a chance of limited strategies to showcase contestants. The organizations additionally limit each other looking to exceed expectations gainful through value initiative. Oligopoly advertise structure This market structure presents changed attributes since the current firms regularly go up against one another in spite of the way that they show a further extent of association. There exists the attribute of non-value rivalry and a frequently plausibility of plot among the organizations. There are hindrances forced to the new market contestants (Oner, 2013). The Californian market structure The business sectors present dive rse possession structures with some portraying level while others delineate vertical structures. Exploration finds out that power creation utilities in Californian markets are approved by the legislature to deliver basically on cost-based methodologies as opposed to administrative methodologies (Stackelberg, et al 2011). In any case, the circulation of intensity through transmission rests directed by the specialists therefore guaranteeing compared flexibly to satisfy the current need instead of leaving the command to the makers who may intend to convey to buyers who will in general posture higher minor utilizations over local purchasers. Apparently, the Californian market structure in the power division is by all accounts a syndication just as a duopoly in that after creation of the force by separated utilities controls the section of new firms. Further, the circumstance prompts the specification of costs in agreement to the desire of the makers be that as it may, the arrangement of duopoly moves to oligopoly as the force creating utilities try to increase plentiful advantages while the specialists control them from getting to the purchasers. Further, monopolistic rivalry wins in the vitality segment of California since the organizations contrast underway of vitality from coal, hydropower utilities, and atomic force creation instruments (Bushnell, Mansur, and Saravia, 2004). Interruption Interception Modification And Fabrication Attacks Computer Science Essay

Interference Interception Modification And Fabrication Attacks Computer Science Essay The correspondence has been assuming a significant job since the beginning of progress. It has become a vital piece of presence in the social orders which are profoundly arranged where we live in. A couple of sorts of correspondence types have been created during the prior phase of human progress which brought about advancing numerous kinds of interchanges till today. The correspondence through the web is the best instances of the most recent correspondence types. There are various sorts of interchanges winning in our everyday life, for example, Radio correspondence, Mobile correspondence, Telephonic correspondence and Network correspondence. Every correspondence type has its own significance yet the correspondence over a system has been for the most part actualized in our life and has been advanced as the most remarkable and profoundly created specialized strategies. The system specialized technique has made an incredible effect on lives of people. So as this technique is bit by bit creating and being utilized by numerous people and associations, such development in the innovation has brought about the security issues, for example, dangers or vindictive assaults to the people and associations. So there is a need to experience these dangers and assaults which brought about the presentation and improvement of various components for offering various types of assistance and CRYPTOGRAPHY is one of the instruments which is generally utilized in the system correspondence. Sorts OF SECURITY ATTACKS: There are various sorts of security assaults which influence the correspondence procedure in the system and they are as per the following Interference: This sort of assault is because of the deterrent of any sort during the correspondence procedure between at least one frameworks. So the frameworks which are utilized gotten unusable after this assault by the unapproved clients which brings about the wastage of frameworks. Capture attempt: The wonder of privacy assumes a significant job in this sort of assault. The information or message which is sent by the sender is caught by an unapproved person where the message will be changed to the diverse structure or it will be utilized by the person for his pernicious procedure. So the privacy of the message is lost in this kind of assault. Adjustment: As the name shows the message which is sent by the sender is changed and sent to the goal by an unapproved client. The honesty of the message is lost by this kind of assault. The beneficiary can't get the specific message which is sent by the source which brings about the lackluster showing of the system. Creation: In this sort of assault a phony message is embedded into the system by an unapproved client as though it is a legitimate client. This outcomes in the loss of secrecy, validness and honesty of the message. CRYPTOGRAPHY: DEFINITION: The word cryptography is the study of making sure about data by various methods, for example, encryption and unscrambling. The word cryptography is gotten from the Greek word Kryptos which means covered up and graphia implies composing, so absolutely it implies shrouded composing. Cryptology and Cryptanalysis are firmly identified with Cryptography. Cryptanalysis is the way toward breaking the figures and coded without utilizing a key and while the cryptology is the blend of both cryptanalysis and cryptography. During the time spent cryptography the information which is to be transmitted and gotten is enciphered by various keys with the goal that it can't be comprehend by the unapproved clients. Yet, just the sender and collector can have the option to comprehend this information. HISTORY: The idea of cryptography was begun in 2000 B.C. in Egypt where the Egyptians rehearsed hieroglyphics where it is utilized to uncover the narrative of the dead individuals by adorning their burial places and this procedure was polished so as to make them to see increasingly formal, great and honorable however not to conceal the message themselves. Be that as it may, later numerous encryption procedures have advanced for appear into pragmatic applications so as to conceal the data from others. The historical backdrop of cryptography was extremely intriguing and numerous progressions have been experienced through numerous hundreds of years. During the times of human progress the significant issue was the support of mystery because of the various reasons by people or gatherings and this mystery upkeep helps the people or gatherings to increase a serious edge, the genuine goals of every individual can be covered up and furthermore the shortcoming can be decreased. The development s or advance in the innovation has brought about the progressions in cryptographic history. The procedure of cryptography has started by designing the message on wood or stone and afterward it is sent to the individual who must be gotten and it is deciphered to the first content by various procedure. Be that as it may, the improvement of cryptography has experienced numerous progressions from cutting the message on wood to the surge of paired codes. These floods of parallel codes are transmitted over system wires, wireless transmissions and so forth previously yet now these twofold codes are sent as 0s and 1s through web links or open wireless transmissions. These bundles are scrambled with the goal that they are not upset by the unapproved clients. The Egyptians have begun the procedure of cryptography by supplanting the first message with the distinctive message with the assistance of figure and this procedure is known as replacement figure where each letter in the message to be s ent is replaces with the diverse letter so unapproved can't comprehend. This message is again retransformed to the first structure by the beneficiary. For instance the sentence or message STAFFORDSHIRE UNIVERSITY (Plain content) is changed to TUBGGPSETIKSF VOJWFSTJUZ (Encrypted text or figure text) where each letter is replaces with the first letter so nobody can comprehend. Old METHODS OF CRYPTOGRAPHY: During the old occasions there were diverse cryptographic techniques which have been actualized for making sure about the information securely with the goal that it can't be gotten to by an unapproved client. So the various techniques are as per the following Hebrew cryptographic technique: This is one of the antiquated strategies for cryptography where flipping of the letters in order happens so that the mapping of the each letter in the first letters in order and the flipped letter set ought not coordinate each other that implies the comparing letter in the first letters in order ought to be diverse in the flipped letters in order and this strategy for encryption is known as atbash. ABCDEFGHIJKLMNOPQRSTUVWXYZ ZYXWVUTSRQPONMLKJIHGFEDCBA For instance the encoded type of the word Staffordshire University is hgzuuliwhsriv fmrevihrgb. Spartans technique: This strategy for cryptography was actualized around 400 B.C. by the Spartans where they used to encode the message or data by utilizing a sheet of papyrus and a wooden stick or pole. The message which is to be sent is composed on the papyrus and it is injured around the stick or pole and this data can be known by the beneficiary just when the message was injured around the right staff with the goal that the letters would appropriately coordinate. This procedure is known as scytale figure and when the paper is expelled from the stick or pole the message which was composed on the paper was simply found as the gathering of the irregular characters and this various pieces papyrus are sent to gathering of fighters by Greek government with the assistance of bearers. Subsequent to accepting the papyrus the fighters at that point wound this papyrus around the stick or pole which is of equivalent distance across and length so the letters which are irregular match with the letters with the subsequent pole and the message which is sent can be known. The troopers utilize this strategy for the data about the key moves and military orders. Julius Caesar technique: This is additionally one of the old strategies for cryptography where Caesar built up a strategy where the letters of the word are moved by some number which is set. He built up this technique on account of his non trustiness on his errand people. So he used to move the letters by the number 3, for example, the letter An is supplanted by letter D. So the person who knows the move by 3 standard can just unravel the message. Understudy (Plain message) VWXGHQW (scrambled message) Idea: The primary idea of cryptography is the way toward making sure about the data by changing the first type of the content or message to the structure which can't be perused by the unapproved client. The message which is sent initially by the sender is known as plaintext which can be perused by everybody and the encryption method is applied to this plain content which brings about the arrangement of figure text or scrambled content which can't be perused by an unapproved client. An encryption calculation is utilized to change over the plain content into figure text and again this figure text is retransformed into plain content by unscrambling calculation. This implies cryptography is the science which is utilized for ensuring the message or data by giving various ways and procedure so as to change over the message or data which can't be perused by anybody. The information or message is changed over so that the No entrance of information for an unapproved individual Data present in the information outlines is covered up Information validation is shaped The adjusting of the information is maintained a strategic distance from The message originator can't abandon the information So the data which is transmitted on data and correspondence frameworks can be ensured or made sure about by the innovation known as cryptography. This innovation is applied in numerous fields, for example, account, individual information, military etc. This innovation gives a methods for confirmation check of the information with the goal that the genuine offender can be gotten who intrudes on the classification and uprightness of the information. Various TERMS IN CRYPTOGRAPHY: Cryptography: The study of securing the message or information by utilizing various strategies is known as cryptography. An articulation is applied from the other created nations by the scientists as a macroeconomics groundwork for the improvement of eastern Asia in the new period. The private enterprise model shows that the nation powers are in the hands of government as far as choices, cash and rights. Government chooses the distribution and checking of the different exercises of the economy the board. The term has oftentimes been utilized for the nations, which are outside from the Asia Pacific and satisfy the necessities of developed landmass (Castells, 2010). Chalmers Johnson who fundamentally conceptualizes the mainland at first presented this idea. He likewise engaged that this economy is having rationale towards progress, making required strides and making approaches the board to accomplish that objective. Perceived by Johnson (1982), in American writing formative state is considered as fundamental forward leap on Northeast Asia. It is at first concocted as an explanation of industrialization in Northeast Asia thinks formative state as a spot that is having a few assets and modest work, which will results to advance when capital is presented in this economy and political choices will liable for arrangements of money related life in entrepreneur upper east Asia (Cai, 2010). The formative state hypothesis is consequence of the watched data in different eastern nations However; formative state is definitely not another idea. As an innovator in this extension, numerous researchers follow Johnson. The model of formative state has become the key stream explanation. Still there are a few inquiries exits on the system of the formative state. Like, is the formative state support by explicit history and culture? What is as far as possible for formative state? Can the formative state information in East Asia be moved, etc? Whats extra, due to the pre speculation of state obstruction, the model of formative state is seen as a casual hypothesis somewhat contributing the speedy development to energetic state activities that may not be genuine constantly, yet in any event to some degree the truth (Beeson, 2014) A dictator state manages the country with the assistance of a few bodies, which principally controls the various zones liable for the development of a nation. It controls the market, trade framework, monitory framework and different exercises inside a nation. It additionally gives state funded instruction and national resistance, which are unrealistic to work without guideline the board. Without this framework, there are odds of disappointment in the economy. To build up the economy and making it more grounded the formative state advances the new enterprises and decreases the uprooting purpose behind this moving of dare to different nations (Yahuda, 2011). The administration of formative state should concentrate on greater venture and welcomes the more industrialists to put resources into their state and help them in building the businesses in their state. It will influence the economy decidedly and produces the more chances of occupation in the economy to defeat business issue and better open doors for utilized populace. To keep up the steady large scale economy, it is imperative to have joint effort between the significant ventures and the state (according to Alice Amsdens the inclusion of the administration in showcase like financing of endowment to improve intensity of firm, wages and stop deceptive controlling of cost to cut down production cost. It is additionally vital for development of ventures and economy, and control of conversion scale, which is basically found in late industrializes nations. Much the same as case in Japan, there are slight government privileges of assembling area, yet non-government segment is limited and carefully coordinated by elites bureaucratic bodies. (Chan, et. al., 2016). Official are not chosen these bureaucratic government elites and are along these lines matter to control through the business class and common laborers during the political technique. The rationale from this viewpoint is that an administering office are having the freedom to structure the money related framework or run over to long-standing across the country government aides with budgetary techniques hindered through any working gathering or business bunch thin premiums. After the Second World War the East Asian economies has indicated quick development and turns into a perceptible concentration in scholarly for quite a while. There are a few significant attributes of the formative states administration in East Asia. Speculation and benefits for the state is thoroughly rely upon their choice and arrangements, which is made by the legislature. There is significant conversation on improvement, need of industrialization and the contribution of the state to support it. What's more, it is where Japan and other eastern nations need behind western nations because of impact from untrustworthy gatherings results to expected and discerning advantages in Japan. (Evans, 2012) the little, best government is enrolled from the top positions of the top graduate school, the choice is completely founded on the national assessments designs and is unaltered by political race results. The organization diagrams for all intents and purposes all mandates, laws, guidelines, licenses and requests that standard society. Also, it has extra legitimate forces of regulatory direction and is sensibly unreasonable in any methods by the lawful framework (Gereffi, et. al., 2014). A formative state implies a sound government, which has enough force and assets to accomplish its formative objectives. According to a report discharged by the World Development, the establishment of a decent government is framed by the proficient gracefully of products and enterprises, for example, arrangements and associations. These assets get blast the business sectors and increment people groups living of guidelines. It has been seen that todays dynamic world requests a vastly improved and dire procedure of advancement (Leigh, and Blakely, 2016). Without formative express, the financial improvement of immature nations can't be envisioned. , Moreover, it is obvious that the underdeveloped countries have involved a huge zone on the earth, which is probably going to frame a significant piece of things to come globalizing world in the closer future. Along these lines, the formative In this view, after the Second World War, a quick development was seen in the greater part of the Asian organizations, for example, USA, Japan, China and Thailand. While USA is an administrative arranged nation, Japan is a formative situated country. These nations are a genuine case of Economic accomplishment because of formative states. In the course of recent decades, a portion of a definitive possibilities for monetary achievement have likewise been found in Singapore, India, Taiwan, India, Malaysia, Vietnam, Indonesia, and Philippines. These countries have encountered from high to direct pace of advancement. Since 1980s, Thailand has been developed at twofold speed in most extreme years (Beeson, 2014). Then again, China has been driving the globe as far as financial development and headway in numerous years since 2001. Moreover, it is discovered that United Kingdom took roughly sixty years to speed the pace of its monetary advancement in the underlying time of Industrial upheaval . Then again, America took fifty years to turn out to be completely evolved state in the time of American financial take-off in the late nineteenth century. At present, various nations can be seen boosting their formative expresses at regular intervals. Moreover, in a significant number of these Asian countries, not just the rich and prosperous individuals are getting more extravagant yet in addition the way of life of white collar class and needy individuals is expanding enormously. In Thailand, the pace of neediness has declined from 1960s when in excess of 60% of the individuals were living beneath destitution line and enduring because of the absence of necessities. By 2004, the circumstance was improved and as per the World Bank figures, this nation has indicated the most noteworthy record in limiting neediness and upgrading GDP rate over the globe in contrast with different nations (Chan et al., 2016). The Asian nations like Thailand, Singapore, and Japan have built up a solid government and effective pioneers who can contend with multinationals for ensuring and advancing their people groups intrigue. They have gotten effective in making and keeping up a string of long haul formative state development for the financial turn of events. End The report reasons that there are different strategies by which monetary is effective in formative state. The report center around the approaches made by the legislature that pulls in the huge industrializes to set up their industry in formative state. The administration allows the auxiliary to the industrialist to pull in their state; it will help in improving the general public since it creates income and openings for work. Obama had lost his seats on the House of Representatives. Will on was the main other president in history to lose a bigger number of seats than President Obama. The tale talks on how five officeholder presidents since 1 896 had lost reel activity and afterward starts to clarify why those equivalent components didn't make a difference to President Obama.Us retain the four contentions the creators make. The rival NT Mitt Rooney didn't have a capable execution when he needed to introduce his arrangement NSA on if he somehow happened to be chosen, in addition to the fact that this showed a portion of his blemishes as a speaker al so as a competitor. Rooney had an excessive number of feeble focuses that Obama had the option to TA squeeze bit of leeway of to persuade the American individuals he was as yet their best choice. R cash pushed his couple of focal points way too far.He remained on one theme the whole Tim e and would thoughtlessly discuss that equivalent subject, which was an imperfection on his part particular Y near the decisions. In the event that Mitt Rooney had given better addresses and understood a portion of his missteps before races, the result may have been diverse in 2012. Sum up the contentions that the creators made concerning the outcomes from the 2012 races and what they may inform us regarding the 2016 decisions. The principal point made by the creators utilizes measurements to foresee that the president till political decision in 2016 will be a fight for the most s wing states. In 2012, Barrack Obama had picked up the states that he won in his past political race. These states had additionally been the as me couple dates that the last three law based presidential applicants had won also. Rooney had likewise won the states that past republican competitors had won too. There were just n,vow states that had changed between the 2008 and 2012 decisions. Became utilization of how the republicans have lost the last two presidential decisions (Including the 201 2 races), they have some genuine work to do and they should pull off swinging various s dates in the 201 6 races (something that hasn't occurred fifty-fifty a century). The second purpose of the section talks on the adjustments in demography. In wager when the ears of 2008 and 201 2 rates of the ethnic gatherings that vote democrat expanded high. These voter increments were truly observable with an expansion in youth h support, particularly for democrats. With no clarification the quantities of e thnic race s that vote republican dropped. The republican votes that dropped during the choose On W ere shockingly white guys. This established a connection that the young were in co liquefy backing of Obama. This is significant on the grounds that later on no doubt they will proceed to help the democrats. At a similar time it is truly conceivable that the turn UT was very low in the 201 2 race turnout for some positive republican classes w as very lower than anticipated. Minorities wouldn't decide in favor of Mitt Rooney basically on the grounds that SE their personality with him was practically nonexistent in the event that he would turn into the following manage .NET. This very actuality coupled those not on the side of Obama, this prompted individuals not casting a ballot by any means, which seriously hurt the republican repel's odds of winning the race. Minor ties can generally adjust their perspective on who they will decide in favor of or regardless of whether they should cast a ballot at all relying upon the status of the economy at that time. That very actuality may lead o the republicans improving intrigue to the minorities in the 2016 decisions, a ND they could influence them, particularly if no democrat could like President Obama. There was a concise blast of employments made during this period, this would wind up breaking down inside a brief time of time.Demo rodents had initially said that during the hour of President Beam's first term that he ha d really reque sted the high joblessness rate in America. Republicans were found to have said that in light of how gradually the improvement of the economy has been, press scratch Beam's approaches in office hindered the normal advancement of improving the economy. This put forth their defense for the downturn being one of the longest ever. The thriving of the across the nation shortfall and obligation turned over onto President Beam's first term in 2008. In the â€Å"Obama era†, the national obligation never fell underneath the sum off trillion dollars. The normal in the main term was 1. 33 trillion dollars. This friend catch was shocking on the grounds that nobody could have anticipated such a number a coo supplication yea RSI before Beam's political decision. The general government spending measure of the GAP ha d expanded almost 5% from 2007 to 2012. Republicans proceeded to state that Barrack Obama administration was the genuine reason for the entirety of the spending. To counter that a nnouncement NT, Democrats had reacted saying that an expansion in the shortage was similarly as UN avoidable as the last President who happened to be a republican (George W.Bush) who ha d initially put America in this very pickle. Political promotion had become a major issue during Beam's first term. In such a partitioned government, agreeing between the two democrats and re publicans was amazingly troublesome. What did the 2010 midterms uncover about legislative issues broadly? It was uncovered that the American individuals were intensely on the side of Republican NSA Simply on the grounds that President Beam's first term had not been the best in the â€Å"popularity y contest†. Essay about Enrons Organizational Culture - 957 Words

â€Å"Enron’s organizational culture† Questions for Discussion 1. Explain how Enrons culture influenced practices outcomes, include advantages and disadvantages Answer: the advantages of Enron’s culture are that they were very aggressive (saying yes to other projects) and unethical (corruption, corners cutting), in that way the company can generate a quick grow. But the disadvantages are very high; they completely lost control of the company because they gave freedom to young and inexperienced people. Another problem was the way they gave incentives to their employees was wrong, that promoted a hostile environment controlled by their â€Å"star employees† who only had personal ambition, and they didn’t care about teamwork. Also†¦show more content†¦This compensation strategy is a good idea only if companies has the right control over their people, and know how to effectively measure the overall performance of their employees. c) Also their unusual performance review system was completely wrong; skilling gave too m uch power to 20 people. While your response to #3 might overlap to a degree, please be more specific here and describe the role of leaders in shaping Enron’s culture. Be specific (e.g., provide examples). * Jeff Skilling had a good idea of creating a new and flexible culture, so the company can adapt easier against economic changes or/and problems (globalization, resource allocation, etc.) but he didn’t execute well, and I personally believe that Skilling didn’t fully understood how to create teamwork in his company. For example, the culture was heavily built around star players, such as [Lynda] Clemmons, with little value attached to team-building. (The organization rewarded highly competitive people who were less likely to share power, authority, or information). * Also Jeff Skilling didn’t match the right employees with the right position, which ended in placing people to do tasks that they are notShow MoreRelatedEnrons Organizational Culture : Enron1643 Words   |  7 Pagesrise and fall so quickly? Chaplain’s roles: Integrating spiritual care into the health system In this paper I will be discussing the role of the chaplain in the health care system, importance of collaboration between chaplains and health care professionals, discussion on ethics, and the roles that spirituality, culture and religion play in positive health outcomes. The occupation of a chaplain comes with many different roles. Their duties include comforting, listening, and being a guide as patients travel through a world of emotions. Here in the U.S. health care chaplains play a big role in providing spiritual care and support for patients. Referring back to the mini lecture on religion and health. Spiritual assessment and care are being integrated into patient care plans. Maggie A Girl Of The Streets Essay - 551 Words

Maggie: A Girl of the Streets by Stephen Crane is a short novel about a young girl and the people in her life. Despite its brevity, this book displays many significant themes that its author intertwines in the story plot. Such themes are determinism, hypocrisy, false morality, self-deception, and appearance verses reality.Maggie’s mother, Mrs. Johnson, is a symbol of hypocrisy in the story. She lost her husband, and had to raise her children by herself in poverty. She drinks to heal her pain so that she doesn’t have to face reality. She wants to be seen as quot;properquot; and the ideal mother. Yet she drinks regularly and goes into violent rages, throwing things around, and destroying her house. It is contradictory that Mrs. Johnson never reprimands Jimmie for the trouble that he is involved in. If anybody could comprehend and associate with Maggie’s feelings of loneliness and hopelessness, it should have been her mother. Mrs. Johnson is too preoccupied with her addiction to alcohol and trying to impress the neighborhood to do anything beside condemn Maggie’s way of life. Mrs. Johnson thinks that she is the ideal mother who gave her children everything they needed and more. This is the false morality depicted in the novel since she was actually the opposite. For the Younger family, having a good paying job is a part of their American Dream, but sadly they have a difficult time trying to achieve this aspect of the dream due to their race. Most African Americans during the 1950’s made significantly less money than White Americans. â€Å"The average black household income in 1955 ($2,890) was 55 percent of that of white households ($5,228)† (Fuller par. 4). This difference in income was because of the jobs that were open for colored individuals. Like Mama, Ruth and Walter, most Blacks had service jobs that usually served Whites. For instance, Walter is a chauffeur for a white man. This low paying job barely allows him to provide for his family and definitely does not fulfill his American Dream. Plaintiff declared that he experienced harassment from his colleagues and from the management while working at the City of Weirton. He cited several incidences such as a fellow employee pulling down his pants and shaking his buttocks at him and the frequent summons to the office of the manager for flimsy reasons such as the tardiness of another employee or another person’s absences or being written up for no valid reason at all. Plaintiff alleged that the conduct he experienced from his employer and from his colleagues forced him to resign from his employment even though that was against his will. He filed this suit for wrongful termination. Plaintiff filed this suit at the Brooke County Circuit Court. II. Standard of Law Under Rule 12 (b) of the West Virginia Civil Rules of Procedure Every defense, in law or fact, to a claim for relief in any pleading, whether a claim, counterclaim, cross-claim, or third-party claim, shall be asserted in the responsive pleading thereto if one is required, except that the following defenses may at the option of the pleader be made by motion: (1) lack of jurisdiction over the subject matter, (2) lack of jurisdiction over the person, (3) improper venue, (4) insufficiency of process, (5) insufficiency of service of process, (6) failure to state a claim upon which relief can be granted, (7) failure to join a party under Rule 19. III. Argument a) The court should grant brief in support of motion to dismiss because the Brooke County Circuit Court is not the proper venue for this suit. The Supreme Court of Appeals of West Virginia has extensively answered the question of venue in a civil action in the United Bank, Inc. v. Blosser, No. 32691. Citing the  § 56-1-1 of the W. Va. Code, the Supreme Court of Appeals of West Virginia stated that: â€Å"a) Any civil action or other proceeding, except where it is otherwise specially provided, may hereafter be brought in the circuit court of any county: (1) Wherein any of the defendants may reside or the cause of action arose†¦ Well-settled is the rule in statutory construction that when a statute is clear and unambiguous then there is no room for its interpretation. Its plain meaning should be accepted and applied without the need for interpretation. In this case, the cause of action arose in the Hancock County where the City of Weirton is located. It is there where the act of wrongful termination was committed. There could be no other venue for this wrongful termination suit except in the Hancock County. Venue relates not to jurisdiction but to trial. It touches convenience, not substance. However, the choice of venue for filing civil suits should not be left to the plaintiff’s whim and caprices. Facts such as judicial economy, proper administration of justice and the convenience of the parties must not be taken for granted since they are the reasons for which the rules of procedure and venue were formulated. In this case, since the City of Weirton is located at 200 Municipal Plaza, Weirton, West Virginia which is at Honcock County there could be no other venue except the Hancock County. B) Court should grant brief in support of Motion to Dismiss because the motion to dismiss on the ground of improper venue was timely filed pursuant to the doctrine enunciated in the case of Higgins v. Alpha Burnett (01-801) The Supreme Court of Arkansas in the case of Brenda Higgins v. Alpha Burnett, et al, Opinion delivered June 6, 2002, discussed the importance of filing the defense of improper venue at the earliest opportunity. That case involved an action for fraud and conversion filed against two defendants residing in Lonoke County. The suit was filed in Faulkner County Circuit Court. The defendants filed their answer which was generally in the nature of mere denials. They did not raise any affirmative defense of improper venue nor did they reserve the right to raise this defense. It was only after fourteen months that they filed their motion to dismiss raising as a defense improper venue. The trial court granted the motion and dismissed the suit. In reversing the trial court’s decision, the Supreme Court of Arkansas said that the defense of improper venue had been waived by the defendants when they failed to raise the same at the time they filed their responsive pleading. â€Å"Because appellees did not raise their valid defense of improper venue in the answer, or by motion filed prior to or simultaneously with the answer, we hold that the defense was waived; therefore, the case is reversed and remanded†¦Ã¢â‚¬ Ordinarily, the rules of civil procedure must be liberally construed. However, the provisions on period within which to raise certain defenses are strictly applied as they are deemed indispensable to the prevention of needless delays and they are necessary to the speedy discharge of judicial business. In this case, the defendant has timely filed his defense of improper venue. The motion to dismiss should therefore be granted. IV. Conclusion For the foregoing reasons, defendant respectfully requests that this Court grants defendant’s motion to dismiss this suit for wrongful termination on the ground of improper venue. Following the W. Va. Code  § 56-1-1, the suit shall be filed in the county where the defendant resides or where the cause of action arose which is Hancock County where the City of Weirton is situated. CERTIFICATE OF SERVICE I hereby certify that the above Brief In Support of Defendant’s Motion to Dismiss was served upon the Plaintiff on August , 200 by mailing a true copy by certified mail to: How to cite Brief In Support Of Defendant’s Motion To Dismiss, Papers

Hamlets Delay with Revenge Essay Example For Students

Hamlets Delay with Revenge Essay Delay stalked Hamlet and his scheme to murder his rival, uncle, and deemed father, Claudius. Hamlets visiting with the ghost in Act I, Scene V, included multiple challenges and tasks applied to Hamlet by the ghost. Revenge his foul and most unnatural murder. Hamlet vows a fast and swift revenge, however encounters experiences and ways that delay his destiny to avenge his fathers death. In the end, Hamlet fulfills his goal and takes revenge on his fathers death and murder.Hamlets character shows much discouragement, earnestness, and sensitivity towards his new found sorrows. Being a religious man, Hamlet forsakes the plan too kill himself for reasons of confusion, guilt, and terror towards suicide. He instead removes this idea and the worries about his fathers death, his mothers quick marriage, and his uncles robbing of his mother and the crown. For his new father all he must say to describe his juxtaposed thoughts is A little more than kin, and less than kind.(I, ii, 64). And of course Hamlet cannot match his peer-rivals Laertes and Fortinbras in the area of killing. He is too much involved in lucid Owad 2thoughts too find will to kill. In Acts II and III, critics argue, two months have passed from the death of the king. Hamlet finds himself involved in plotting a play. He had been brooding for two months thus far. He designs the actors speak the verses directly to the King, Claudius. This action by Hamlet serves him well, the play mimicking the lives of the royal family, and Claudius is greeted with guilt and solemn grief. How smart a lash that speech doth give my conscience!(III,1,49) He flees to a place of worship and repents. O heavy burden!(III,1,54) Hamlet conveys this and halts on his terms of revenge on him. Hamlet then goes and speaks with his mother, for she has summoned him. He then kills Polonius being mistaken for Claudius. How now ? A rat? Dead for a ducat,/dead!(III,iv,24-25) This further dampens Hamlets plans. In Act IV Hamlet is now sent away to England by the king. Rosencrantz and Guildenstern have taken up the job of seeing that he makes it there. Hamlet intercepts a message that orders his death and plans the deaths of Rosencrantz and Guildenstern. These courses of actions have set back Hamlet indefinitely. Hamlet succeeds in Act V after he returns to Denmark. The king and Laertes, whose sister just had just parished, have plotted a mission to kill Hamlet once and for all. Hamlet realizes unfair play, yet he accepts the challenge of the duel between himself and Laertes. Including the fact that Hamlet has no plan in Owad 3The anticipation of the duel. The plot of the story thickens here. Gertrude is deceased, because of the poison meant for Hamlet. Both Laertes and Hamlet have been struck by the poison foil. Realizing his own inevitable death, Hamlet thrusts the sword into Claudius and forces him to drink the poison wine. Here thou incestuous murdrous, damned Dane, /Drink off this potion. Is thy union here?/Follow my mother.(V,ii,326-339) Ultimately Hamlet has succeeded, however he had lost his life in the process of avenging his fathers death. Many factors had delayed Hamlet and his revenge on his fathers death. Yet in the conclusion of the play he finally succeeds in the task given to him by the ghost in Act I.

Hydration Creatine Phosphate Energy Essay

Hydration Creatine Phosphate Energy Essay Hydration: Creatine Phosphate Energy Essay Unit 1 principles of anatomy and physiology in sport Energy systems There are three different types of energy systems within the body. Through the use of adenosine triphosphate (ATP) the body is able to maintain a constant supply of energy. APT is formed during a reaction between adenosine diphosphate (ADP) and a molecule of phosphate. ATP consists of a molecule of adenine and three phosphate groups. When the ADP joins with the phosphate molecule energy is stored within the bonds, when the bonds are broken the energy is released. Energy can also be released when ATP is combined with water. The body can function both aerobically and anaerobically this allows different body systems to use the one which will be most beneficial to them. During prolonged activities there will be a high amount of oxygen required will be powered by aerobic systems. For activities which require no or very little amounts of oxygen will be powered by anaerobic systems. Energy is acquired through the oxidation of mainly carbohydrates and fats. When carbohydrates are broken down they change into glucose, this can then be stored by the body as glycogen in the liver and muscles. Fats are broken down to form fatty acids. There is three ways in which ATP can be produced these are creatine phosphate energy system, the lactic acid energy system and the aerobic energy system. The creatine phosphate energy system The creatine phosphate energy system is the first energy system; it is made up of ATP (adenosine triphosphate) and creatine phosphate. It is readily available and produces ATP rapidly, although it only exists in limited concentrations, only lasting for 10 seconds. The creatine phosphate is stored within the muscles and is used when the need for energy is instant or the intensity is high. This is most likely in sports such as sprinting and power events. This type of energy system produces ATP without the use of oxygen as it is such a quick process; this is why it only allows it to be used for very short periods of time. The creatine phosphate produces one molecule of ATP and one of creatine. Lactic acid energy system This is the second energy system which is able to sustain the body for longer periods of time but still at a high intensity. In this process energy is produced by the breakdown of glucose and glycogen. Just as the creatine phosphate system this works anaerobically which means without the presence of oxygen, therefore this limits in to working for only 60-90 seconds. This type of energy system would be used for activities such as the 400m which still require high intensity but over a longer period of time. During this process glucose if obtained from foods such as fats and carbohydrates, if the glucose is not required at that time it will then be stored in the body as glycogen. When glucose is broken down it produced 2 molecules of ATP as well as 2 lactic acid and heat. When glycogen is broken down it produces 2 molecules of ATP, 2 lactic acid and heat. Lactic acid is the by-product which is produced; it builds up and then diffuses into the blood and tissue fluid. When lactic acid is not removed it causes the muscles to stop contracting and fatigue will set in. Aerobic energy system The aerobic energy system produces large amounts of energy but which can last for long periods of time at low intensity. It is the long term energy system which is used in everyday activities. In the presence of oxygen glycogen and fatty acids break down producing ATP. Glucose produces 38 ATP, carbon dioxide, water and heat. When fatty acids break down they produce 129ATP, carbon dioxide, water and heat. Carbon dioxide, water and heat are the by-products but unlike lactic acid to not affect the muscles ability to contract. Recovery periods Depending on the type and intensity of activity the recovery periods will differ in order to take into account the amount of damage to the body. The length of a recovery period depends
